PPP Loan Forgiveness Update

October 7, 2020

As we have mentioned in previous updates, Congress continues to discuss legislation that would ease the process of loan forgiveness for PPP borrowers with loan amounts less than $150,000. It was our hope that by now we would have seen this legislation come to pass. Unfortunately, it continues to be delayed.

The Independent Community Bankers of America Association is now calling on community bankers to enlist small-business customers in urging Congress to immediately pass legislation to simplify Paycheck Protection Program forgiveness.

The link provided below will direct you to a call alert provided by ICBA for small-business owners to make it easy to call lawmakers and urge passage of the Paycheck Protection Small Business Forgiveness Act (H.R. 7777/S. 4117).

The bipartisan bill would provide simplified forgiveness for PPP loans of $150,000 or less. ICBA has led the push for simplified forgiveness and repeatedly called on Congress not to leave Washington without passing this urgent legislation.

We continue to monitor any changes to the PPP rules regarding the forgiveness application. Earlier this week, Congress reconvened and resumed their discussion of a new stimulus package that may result in changes which could simplify the forgiveness application process. Because of potential changes to the Loan Forgiveness process, First American Bank is not accepting applications for PPP Loan Forgiveness at this time. Our hope is that these proposed changes will be implemented within the next few weeks. As soon as we hear something, we will let you know.

Remember that you will not be required to make any loan payments until after your PPP Loan Forgiveness Application is processed and we receive a decision from the SBA regarding any loan balances, if any, that are not forgiven. All loan payments will be automatically deferred until that time.

As you know, there have been many changes to the PPP rules and applications over the past couple of months. We still continue to receive changes on a weekly basis and there is a discussion of more changes that might be possible. Because of potential changes to the Loan Forgiveness process, First American Bank will not begin to accept applications for PPP Loan Forgiveness until August 3, 2020.

Please read the instructions to Form 3508EZ to see if your business qualifies to file the Form 3508EZ. Please remember there is a possibility that these forms may change. If the forms do change, we will notify you accordingly.
